Social network TikTok has filed a lawsuit seeking a review of the law signed by Biden on the potential ban of the platform due to its unconstitutionality, The Washington Post reports.

In their 67-page motion for a review of the constitutionality of the law, filed against Attorney General Merrick Garland, TikTok and ByteDance argue that the law would grant the government unprecedented powers to control or dismantle a platform it dislikes.

“The TikTok ban is so plainly unconstitutional that even the law’s authors acknowledged this reality and therefore strenuously attempted to portray the law not as a ban, but simply as regulation of TikTok ownership,” the lawsuit states.

WP believes that the Chinese have a chance to win the lawsuit, as the US has not yet presented evidence that China collected TikTok user data for espionage purposes or manipulated its recommendation algorithm for propaganda, although the authors of the law claimed that the possibility of future influence is sufficient reason for a ban.
